Section 1050 - Pollution of Stream, Creek, Pond, River
Section 1050:00. Acts Prohibited. The act of dumping or discharging any raw sewage, garbage, refuse or other waste, including but not limited to, gasoline, oils, crank-case drainings, acids or caustics, directly or indirectly into any stream, creek, pond, river or other water within the corporate limits of this municipality is hereby declared to be a public nuisance and is prohibited.
Section 1050:05. Treatment of Sewage. Nothing in this ordinance shall prohibit or prevent the discharge of toilets, drains or other fixtures from any home or building into the Municipal Sanitary Sewage System, or into a privately owned sewage disposal system where no public Municipal Sanitary Sewer System is available and which privately owned system is of an approved type and is adequate to prevent pollution of any stream, creek, pond, river or other water course within the corporate limits of this municipality. Nothing herein contained shall be construed to authorize the discharge of wastes into the Municipal Sanitary Sewer System which wastes may be, or have been, determined by the Council to be toxic to microbial life or otherwise detrimental to the Municipal Sewage Disposal System.
Section 1050:10. Enforcement. The City Engineer shall be and hereby is charged with the enforcement of the provisions of this ordinance.
Section 1050:15. Penalty. Any person violating the provisions hereof shall be guilty of a penal offense. Every day that such violation continues shall constitute a separate offense. Imposition of the penalty hereby provided shall not be construed as an abatement of any conditions declared to be a nuisance hereunder, nor shall it prevent the abatement thereof by such other means as may be available.
