Section 405 - Advertising Regulations

Section 405:00. Radio and Other Mechanical Musical Devices Prohibited. No person shall maintain or operate in any building or on any street or premises in this municipality any radio device or mechanical musical instrument or other musical instrument or sound device, or amplifying equipment of any kind whereby the sound therefrom is cast directly upon the public streets and places and where such device is maintained for commercial advertising purposes or for the purpose of attracting the attention of the passing public, or which is so placed and operated that the sounds coming therefrom can be heard to the annoyance or inconvenience of travelers upon any street or public place or of persons in neighboring premises.

Section 405:05. Practices Prohibited. No person shall, without a permit therefor, drive or propel, or cause to be driven or propelled, or stop, park or have any vehicle upon the streets or on any public place in this municipality with any musical instrument or device, or amplifying equipment playing music or emitting sounds for the purpose of commercial advertising. This shall not prohibit the use of radios installed or being transported in vehicles, nor shall it prohibit the playing of bands or orchestras in concerts or formal parades, or candidates for public office or religious purpose or other public enterprises.

Section 405:10. Permit Required. No person shall use, maintain or operate in Central Park in this municipality any radio device or mechanical musical instrument or sound device or amplifying equipment of any kind, for any reason, without first having obtained a permit therefor, as provided in this ordinance; provided, however, that no such permit shall be required for the playing of bands or orchestras in said Central Park.

Section 405:15. Application for Permit. Every person, organization, firm or corporation desiring such a permit shall make application therefor to the Council and pay in advance the required license fee as duly set by the Council from time to time.
