Section 540 - Sewer Rates, Charges and Fees

Section 540:00. Definitions. Unless the context clearly indicates otherwise, the words, combinations of words, terms and phrases, as used in Section 540:00 et seq., shall have the meanings set forth in Section 276:03 of this Code, Sewer-Domestic and Industrial Waste Water.

Section 540:05. Industrial Sewer Rates and Charges Established.

Subd. 1. Rates and charges for industrial use and service of the municipal sanitary sewer system are hereby established. Such charges and rates are to be made against each lot, parcel of land, unit or premises which may have a connection directly or indirectly into the municipal sanitary sewer system. Persons or owners discharging industrial wastes which exhibit none of the characteristics of wastes prohibited in Chapter 276 of this Code shall be charged on the basis of the components set forth in Subd. 2 of this Section 540:05.

Subd. 2. As its proportionate share of the expenses incurred by the City in the construction, operation and maintenance of the sewerage works, the persons will pay to the City an annual sum equal to the amount computed by the application of the sampling procedures established by Sections 276:30, 276:33, 276:36 and 276:39 and the following formula:

Where C = Charge to industrial user, with units of $/yr.

f = Average City unit cost of waste water collection and treatment chargeable to volume (flow), with units of $/1,000 gallons

F = Volume of waste water from industrial user, with units of 1,000 gallons per year

b = Average City unit cost of waste water treatment chargeable to BOD, with units of $/1,000 lb. of BOD

B = Weight of BOD from industrial user, with units of 1,000 lb. BOD per year

ss = Average City unit cost of waste water treatment chargeable to suspended solids, with units of $/1,000 lb. of suspended solids

S = Weight of suspended solids from industrial user, with units of 1,000 lb. per year

R = Annual cost of federal and/or state grant repayments, in accordance with regulations applying to grant funds received by the City of Owatonna

Average City unit costs shall be computed annually, and shall include operation and maintenance costs, as well as annual capital costs. Total costs (operation and maintenance plus capital costs) shall be distributed as follows:

Volume (flow) = 40 percent
BOD = 35 percent
Suspended Solids = 25 percent

This distribution will be applied annually, unless changes in the actual cost - revenue pattern render another distribution more equitable.

Initial unit cost figures shall be:

f = $ 0.42 /1,000 gallons
b = 210.00 /1,000 lb. of BOD
ss = 168.00 /1,000 lb. of suspended solids

Section 540:10. Domestic Sewer Rates and Charges Established.

Subd. 1. Rates and charges for domestic waste water disposal service shall be $1.66 per 100 cubic feet of the average amount of water used in the months of November, December and January and billed starting in February and each subsequent month of the year at that calculated amount. To each such statement each month shall be added a service charge based on the meter size as shown in the following table. Eff. 08/01/13

Vacant rental units with individual meters shall be charged only the monthly service charge. Eff. 08/01/13

Single family residential units that are not being serviced by the City water system shall be charged twelve dollars and fifty cents ($12.50) per month plus service charge for 5/8" meter.  Eff. 08/01/13

A charge of seven dollars ($7.00) per month shall be made to new customers and to new residential construction commencing on the date of installation of the water meter and continuing until an average can be struck, from use in November, December and January in addition to the service charge based on the meter size. Customers moving within the City will be charged at the rate established at their previous residence until an average can be struck from use in November, December and January for the new residence. Eff. 08/01/13

Bills are due and payable fifteen (15) days after the billing date on the statement and if not paid at that time, a late payment charge consisting of five percent (5%) of the first one hundred dollars ($100.00) and two percent (2%) of the amount above one hundred dollars ($100.00) will be added. Eff. 4/21/87

Subd. 2. Such charges and rates are to be made a lien against each lot, parcel of land, unit or premises which may have a connection directly or indirectly into the municipal sewer system, and if unpaid may be certified for collection as a special assessment against the said lot, parcel of land, unit or premises.

Subd. 3. Any property owner who fails to comply with Section 276:18 of this Code within the designated time frame indicated in the City's Prohibited Discharges, Storm Water Drainage Policy shall be charged a sewer service surcharge of $100.00 per month. Eff. 4/4/00

Section 540:11. Commercial Sewer Rates and Charges Established.

Subd. 1. The rates and charges for commercial waste water disposal service shall be calculated in the manner established for domestic sewer rates set forth in Section 540:10 set forth above, subject to Subdivision 2 of this section.

Subd. 2. Commercial Units/Optional Method. Upon written application of a commercial unit which sets forth unique circumstances showing that the application of the method set forth in Subdivision 1 creates a special hardship, the City, in its discretion, may calculate the rate of $1.66 per 100 cubic feet of the average amount of water used in the months of January through December of the preceding year and billed starting in February of the current year and each subsequent month of the current year at that calculated amount together with the service charge. The amount so calculated shall be calculated annually. Eff. 5/4/04

Subd. 3. Such charges and rates are to be made a lien against each lot, parcel of land, unit or premises which may have a connection directly or indirectly into the municipal sewer system, and if unpaid may be certified for collection as a special assessment against the said lot, parcel of land, unit or premises.

Section 540:15. Sewer Hook-Up Charges.

Subd. 1. Single family residential tap fees shall be $125.00 per tap.

Subd. 2. Trailer court and town house tap fees shall be $125.00 per tap, which covers the first unit, and an additional charge of $50.00 for the second unit with no more than two (2) units per tap.

Subd. 3. Apartment house and duplex tap fees shall be $125.00 per tap which covers the first unit with $50.00 per additional unit.

Subd. 4. Motel, rooming house, dormitory, office, business place, factory, nursing home and any other multiple use shall be $200.00 per tap which covers the first unit or water closet and $10.00 for each additional water closet.

Subd. 5. All charges hereinabove set forth shall be payable in full upon application for connection, regardless of the size of the property or the number of connections to the sanitary sewer system.

Subd. 6. Unit tap fees established above in Subdivisions 1 through 5 shall not be construed to mean the connection from unit to sewer riser or lateral. Each unit site shall pay only one (1) initial tap fee.

Section 540:20. Industrial Waste Water Discharge Permit Fee.

Subd. 1. A fee for Waste Water Discharge Permit, as authorized in Section 277:11 of this Code, shall be $200.00.

Section 540:25. Residential Septic Tank Discharge Fee. A fee for a septic tank discharge, as authorized in Section 276:70, shall be $50.00 per load up to 1,000 gallons, $100.00 for loads of 1,000 to 2,000 gallons. Eff. 10/1/91

Section 540:30. Sanitary Sewer Access Charge. The sanitary sewer access charge (SAC) as authorized in Section 276:80 of this Ordinance Code shall be $2,000. Eff. 3/1/06.
