Section 630 - Protection of Streets, Heavy Engines and Machines
Section 630:00. Heavy Equipment; Permits. No person shall drive, haul or propel nor cause to be driven, hauled or propelled, any machine engine or conveyance of any kind, except automobiles having rubber tires, over, on or across any paved street, alley or public place in this municipality, if any wheel of such machine, engine or conveyance shall have lugs on the outside or circumference of the same which come in contact, or if any such wheel is provided with anything except a smooth and uniform surface to come in contact and which does come in contact, with the paving of any such street, alley or public place; provided, however, that in case it is necessary for any such machine, engine or conveyance to cross any paved street or alley in this municipality, permission to cross the same may be had and obtained by the person owning or operating such machine, engine or conveyance obtaining the consent of the City Engineer to so cross such street or alley under the supervision of the City Engineer and upon providing and laying down planks under the wheels of such machine, engine or conveyance as shall be directed by the City Engineer.
Section 630:05. Damage to Streets. No person shall drive, propel or haul, nor cause to be driven, propelled or hauled, any machine, engine or conveyance over, on or across any paved street, alley or public place in this municipality which shall cause injury or damage to the paving on such street, alley or public place.
Section 630:10. Penalty. Each and every violation of any of the terms or provisions of this ordinance shall be a penal offense. In addition to the foregoing, each and every person who causes any damage to be done to any paved street in this municipality contrary to the terms of this ordinance shall be liable in a civil action for the amount of such damage and the costs of the action, and reasonable attorney's fees to be fixed in amount by the court, such damages to be recovered in the name of the City of Owatonna.
