Section 980 - Trespassing
Section 980:00. Trespassing Prohibited. No person shall intentionally trespass on the premises of another and, without claim of right, refuse to depart therefrom on demand of the lawful possessor thereof or his/her agent. A demand to depart may be made as follows:
Subd. 1. Orally, or in writing, by the lawful possessor or the possessor's agent; or
Subd. 2. By conspicuously posting at reasonable intervals, signs which prohibit trespass on the affected premises; or
Subd. 3. By conspicuously posting at reasonable intervals, signs which prohibit trespass on the affected premises during certain hours.
Section 980:05. No. Re-entry. No person who has received a written demand to depart pursuant to Section 980:00 shall re-enter the lawful possessor's premises without written permission of the lawful possessor or the agent providing said demand for a period of up to one (1) year from the date of the written demand, as provided herein.
Section 980:10. Criminal Prosecution; Penalty. Any person convicted of violating any provision of this Ordinance is guilty of a misdemeanor and shall be punished by a fine not to exceed $1,000.00 or imprisonment for not more than ninety (90) days, or both, plus the cost of prosecution in either case.
